Federal and state government legislates on itemsin the concurrent list. It should be recalled that a federal state is the onewhich governmental powers that exist in the country are shared between acentral government of component units (regions, province or states),so that each government independent and autonomous as provided by theconstitution. The powers were shared as follows:a) Exclusivelist- all the powers and functions in the exclusive list are exercised by thefederal or central government only. Some of the items here include; Defense,currency, external affairs, mining, customs, aviation, immigration, census.b) Concurrentlist- all the powers and functions here are exercised by both federal andstate or regional government at the same time. Some examples are education,communication, road, health, finance, etc. incase of any conflict, and thedecision of the federal government overrides that of the state.c) Residual list- the powers and functions in the residual list are onlyexercised by the state government. Some of the items in the residual listincludes such matters are chieftaincy affairs, marketing, etc.
